A white paper with legal recommendations - v. 2
Zenodo (CERN European Organization for Nuclear Research), Feb 3, 2023
The white paper presents legal recommendations from research conducted in the inDICEs project add... more The white paper presents legal recommendations from research conducted in the inDICEs project addressing policymakers in the cultural heritage field on European and national levels. The recommendations rely on recognising the socio-economic values generated in digital cultural heritage following the Culture 3.0 paradigm by Pier Luigi Sacco. This paradigm blurs the boundaries between producers and users. “Cultural producers and users are enabled to interchange roles in a wide range of possibilities” . It thus makes it necessary to redefine the role of copyright 1 itself and its normative shape in the new realm of the heritage sector. Traditionally, the regulatory approach places the artwork understood as an object of ownership in the centre of attention, together with the market mechanisms of its production and distribution, and treats CHI's activity as a marginal element of the system. In contrast, the white paper approach places the artwork as part of the cultural heritage at the centre and CHI's activity as an essential aspect to extract from this heritage the socio-economic values. The traditional approach deprives society of these benefits by insufficient consideration of these values.

Its first thesis states the academia cannot be regarded as an element of the industry supply chain. The second thesis deals with an issue of double funding: the very process of commercialisationof research is based on funding of private and thus commercial enterprises with public resources. Unlike many writings on this subject, it’s not the article’s aim to defend an academic knowledge community in its traditional mode. Drawing on selected private - pubic partnership models, the authors reveal the history of entrepreneurial university concept: its legal and political origin, as well as basic presumptions. In the following analysis they describe and test its utility on its own terms.

The shaping of the content of rights on intangible goods depends, inter alia, on the assumptions ... more The shaping of the content of rights on intangible goods depends, inter alia, on the assumptions made about the models of organization of production processes and distribution of such goods as works or inventions. The currently adopted method of regulating such goods is based on exclusive rights. The aim of the article is to indicate what assumptions justify the adoption of such a model and their critical
analysis. The starting point will be the neoclassical theory of public goods and the theory of incentives based on it, which justifies the creation of exclusive rights for the regulation of intangible goods. The
indication will include that the conclusions derived from the theory of incentives do not take into account all the recommendations flowing from the theory of public goods. The theory of public goods does not
justify, contrary to the claims made within the theory of incentives, that the creation of exclusive rights is a cost-free action, and desirable in every respect. The main point of the analysis is devoted to the assumption of the theory of incentives, which concerns the dominant model of creation and distribution of works and inventions. Contrary to the tacit assumption of this theory, people undertake creative and
inventive activities within various models, guided by different motives. This state of affairs undermines the need to base the system of regulation of intangible goods, such as works or inventions, on the model of exclusive rights. What is more, taking into account other interests of entities creating under various models indicates that exclusive rights are not only not necessary, but can be harmful.

Teza druga sprowadza się do kwestii podwójnego finansowania: uprzemysłowienie uniwersytetów oznacza de facto finansowanie prywatnych i komercyjnych przedsięwzięć z pieniędzy publicznych.

Stąd szczególną uwagę należy przywiązywać do redakcji postanowień określających PE.
